Defamation suit: Light Wave secures order for substituted service against Health Minister

The High Court has allowed Light Wave Health Care Solutions Limited to serve court processes on Health Minister Kwabena Mintah Akandoh through substituted service in the company’s defamation case against him.

The order was made after the company informed the court that attempts to personally serve the Minister had not been successful.

With the ruling, the suit will now proceed through alternative channels approved by the court. These include posting the Writ of Summons and Statement of Claim on the notice board of the High Court’s General Jurisdiction Registry in Accra, sending copies through the Clerk of Parliament for onward delivery to the Minister, and publishing the documents online.

The case itself arises from public statements the company says the Minister made about its operations.

Light Wave claims the remarks, including comments made during media engagements, wrongly suggested that the company exaggerated the number of health facilities it had delivered, received payments for work not fully completed, and fraudulently obtained about 11 million dollars.

It also points to statements allegedly made on Maakye on Onua Television, where the Minister is said to have questioned the functionality of the company’s health information systems and raised concerns about the handling of funds.

According to the company, those comments have created the impression that it acted dishonestly and have caused reputational and commercial damage both within Ghana and outside the country.

In the suit, Light Wave is seeking a declaration that the statements were defamatory, along with a retraction, an apology and damages.
