Supreme Court ruling dismissing Speaker's application well-reasoned
He praised the court’s judgment, handed down on Wednesday, October 30, as well-reasoned and balanced.
Constitutional lawyer and lecturer at the Ghana School of Law, Bobby Banson has voiced his approval of the Supreme Court’s decision to reject Speaker of Parliament Alban Bagbin’s application to overturn a prior ruling that restricted him from declaring four parliamentary seats vacant.
The decision maintains the current parliamentary arrangement, preventing Speaker Bagbin from proceeding with his earlier declaration that the Agona West, Fomena, Amenfi Central, and Suhum seats were vacant.
Banson praised the court’s judgment, handed down on Wednesday, October 30, as well-reasoned and balanced.
He highlighted the judgment's thorough examination of all legal arguments presented, noting that it provided a solid and clear rationale for its conclusions.
He commended the court for its careful handling of the sensitive issue involving both the Speaker and the parliamentary seats in question.
Speaker Bagbin had sought to reverse the Supreme Court’s previous ruling that restricted him from declaring these seats vacant.
Bobby Banson applauded the court for its rigorous assessment of the arguments brought forward by the Speaker’s legal team and other parties involved in the case.
He noted that the decision reinforces public trust in the judiciary, as it reflects a deep understanding of legal principles regarding parliamentary representation and electoral matters.
Furthermore, Banson highlighted that the court’s decision sets an important precedent, underscoring the need for legal checks and balances within Ghana’s democratic system.
